It is. Unfortunately I'm going to have to take it down, though. I just realized it was copyrighted and the page explicitly says "do not use without permission". I got it off of a Google image search and hadn't actually visited the page.
Edit: I've linked to the page where it originates and asked for permission to use it.
It's weird trying to track down someone to get permission to use a picture that's been on the net for 5 years. We'll see if I even get a reply.
This reminds me of when I tried to find the artist who created the picture I have on this page. That picture was created and posted to Elfwood Galleries in 1997 by someone whose name I'd long since forgotten. The only clue I had was a very unclear signature in the lower left corner, and the fact that the picture was stitled, "Padraig". I deciphered some of the signature, and tried several variations with Google and eventually found the right name. Finally 10 years later, I was able to attribute it. That picture is not in his gallery, though, and when I wrote to ask him if I could use it, he never answered my email.
I do have to wonder about that not answering thing. I don't have a web site, so it's not as much of an issue with regards to pictures (at least I hope not). I also can't draw for crap, though I can colour. Therefore I tend to look specifically for line drawings. I have tried to request use a few times, and only got one answer back, which was "sure go ahead, just attribute it as mine". I'm not sure if no comment means "no" or assumed consent so long as it is attributed.
I think it probably means the artist doesn't check the gallery address very often (if ever). People sometimes set up accounts specifically for public forums and galleries, and then after a few years they graduate from school and move on with their lives, and they forget about the accounts.
If the page already explicitly says "no use without permission", though, silence = "no" until I find out more.
In the case of Padraig (up on that page for appx a decade with no complaint from Mark), I'm going with "Attribute and link. If Mark want me to take it down, he knows where to find me and yell at me appropriately."
Thanks. I guess with practice I could get better at it. My favorite ones of mine are on the Waystrands pages (http://www.rialian.com/waystrands) -- I actually really tried with those because two of them were for a Kinships article. Still, they're very amateurish and other people's are so much more magical/beautiful/professional. I've actually asked someone if I could buy a license to use one of his pictures, and he still didn't respond.
There's a flow and naturalness to that one despite it being "amature-ish". What about looking for things that are considered creative commons? You could still alter the photo but could use it so long as you attributed it (at least that's the understanding I have of creative commons).
Thanks! I was trying to do something that captured the spirit of the day, but which avoided little men dressed in silly green tights, and which omitted any references to snake hatahs...
As I said to the creator of the photo when I asked his permission to use it, "This day is a very magical day to me, and is full of that which makes the living alive and turns sun and water into green..."
Anyway, real leprechauns probably look more like this (Today's leprechauns would definitely own a light saber if they could find one)...
Heh. I just had, and shared with a couple of my roommates, a particular type of Irish Coffee called a God's Blessing made with Bushmills Single Malt and Jamaican Blue Mountain.
